General Terms and Conditions (GTC) of lucevivida.com

§1 Validity of the terms and conditions

The deliveries, services and offers of lucevivida.com are exclusively based on these terms and conditions, even if they are not expressly agreed again. With the order of the goods or services these terms and conditions are considered accepted. General terms and conditions of purchase of the buyer are hereby rejected. Deviations from these terms and conditions are only effective if we confirm them in writing.

§2 Quality

Great importance is attached to the freshness and quality of the products and only natural raw materials are used. Luce aims to use its raw materils from its own production in the products offered at this site.

§3 Orders

The order placed by the buyer will be executed as soon as possible, with an average of three calendar days. However, please note that sometimes there may be shortages of raw materials. Therefore, in such a case, we reserve the right to delay the shipment without notifying you in advance. Please remember to provide us with an e-mail address and/or a contact number where you can be reached within a reasonable time in case of any questions.

§4 Terms of payment and prices

All shown product prices are net prices excl. legal VAT. lucevivida.com does not reach the legal turnover of CHF 100'000.- and is therefore not liable for VAT. We reserve the right to change our prices within 10% at any time without prior notice. Payment is possible by debit/credit card through the provider Stripe or through PayPal and on request by prepayment. Seasonal products can also be found out of season via the item search. We reserve the right to charge a higher retail price for these out-of-season products than indicated.

§5 Delivery

Lucevivida.com cannot be held responsible for undelivery or late delivery of products if the cause is an incorrect delivery address, absence of the recipient, customs problems or force majeure.

§6 Inspection of goods

The buyer has to check the goods for completeness upon arrival. If there are any defects or incompleteness, it must be reported to lucevivida.com within 3 working days after arrival. In case of a defect, the buyer is entitled to a replacement delivery. If the elimination of the defect is not solved by the replacement delivery, a reduction of the purchase price can be agreed upon or the contract will be cancelled by mutual agreement. In case of delivery of perishable goods, the warranty claims expire after the expiration of the printed expiration date.

Allergenic ingredients, including, but not limited to cereals containing gluten, sesame, nuts, eggs and milk, are marked with an asterisk in the product details of the online store catalogue. The buyer makes conscious choice considering the potential allergenic reaction when placing the order. Lucevivida.com cannot be held responsible due to allergenic reactions and other health related claims of the buyer.

§7 Data protection

The data collected through the ordering process will be used exclusively for the purpose of complete order fulfillment and processing and will not be disclosed to third parties.

§8 Copyrights and legal notice

We reserve all rights (text, images and graphics) of our website. The entire content may not be copied, published or used for personal use without the written consent of the management of lucevivida.com. Lucevivida.com does not give any guarantee for the correctness of its website such as incorrect or incomplete information.

§9 Validity and place of jurisdiction

Adliswil is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law. The buyer (user) declares his agreement with the GTC's when he places the order.
